1. Acceptance of Terms

By accessing or using the Essential Vital website and services (collectively, the "Service"), you agree to be bound by these Conditions of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Essential Vital. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use this Service and make purchases. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian.

3. Account Registration

  • You agree to provide accurate, current, and complete information during registration.
  • You are responsible for all activity that occurs under your account.

  • We reserve the right to terminate accounts that violate these Terms.

4. Products and Orders

4.1 Product Descriptions
We strive to ensure product descriptions, images, and pricing are accurate. However, errors may occur. We reserve the right to correct errors and cancel orders placed at incorrect prices before shipment.

4.2 Order Acceptance
Your order constitutes an offer to purchase. We accept your order when we send a shipment confirmation email. We reserve the right to refuse or cancel any order at our discretion, including if:

  • The product is out of stock.
  • There is an error in the product description or price.
  • We suspect fraudulent activity.

4.3 Pricing
All prices are displayed in the selected currency and are inclusive of applicable taxes unless otherwise stated. Shipping fees are additional and displayed at checkout.

4.4 Payment
We accept payment via Stripe (credit/debit card) and PayPal. All payment processing is handled by our third-party providers and is subject to their terms of service. We do not store your full payment card details.

5. Shipping and Delivery

Delivery timelines are estimates and not guarantees. We are not liable for delays caused by third-party carriers, customs, or circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds

We offer a 30-day return policy for new, unopened merchandise in its original condition. Some products may be excluded. To initiate a return, contact us at contact@essentialvital.com.

Refunds are processed to the original payment method within 5–10 business days of receiving the returned item. Shipping costs for returns are the responsibility of the customer unless the item was defective or incorrectly sent.

7. Intellectual Property

All content on this Service — including text, graphics, logos, images, product descriptions, and software — is the property of Essential Vital or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

  • Submit false, fraudulent, or misleading information.

Violations may result in immediate termination of your account and possible legal action.

By submitting reviews, ratings, or other content, you grant Essential Vital a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, publish, and display that content in connection with our Service. You represent that you own or have the right to submit the content and that it does not violate any third-party rights.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Essential Vital SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Essential Vital, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Saudi Arabia, without regard to conflict of law principles. For EU/UK users, applicable EU/UK consumer protection laws also apply and are not excluded by these Terms.

For EU consumers: You may use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.

For all other disputes, you agree to submit to the exclusive jurisdiction of the courts of Riyadh, Saudi Arabia.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

15. Termination

We may suspend or terminate your account and access to the Service at any time, for any reason, including violation of these Terms, with or without notice. Provisions that by their nature should survive termination will do so, including intellectual property rights, disclaimers, and limitations of liability.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
